The Chapter 7 Bankruptcy Process
Chapter 7 bankruptcy, also known as "fresh start" bankruptcy or straight bankruptcy, discharges most unsecured debt, such as credit card bills and medical expenses so that you are no longer obligated to pay them, while allowing you to keep your car, home and 401(k) and other retirement savings.
In addition to discharging debt, filing for Chapter 7 functions as an "automatic stay," meaning that all creditor collections activity must stop. In addition, any communication from your creditors must go through your lawyer.
When you work with me, you can be confident knowing that I will guide you carefully, reliably and efficiently at every stage. Once we have started the streamlined process of preparing and filing your petition, I will continue to be at your side throughout the bankruptcy process:
- I will notify you promptly when I file your case, and I will tell you your case number and hearing date at that time.
- A week after the case is filed, creditors will be notified.
- Four to six weeks later, a court hearing called the "meeting of creditors" will take place. I will be at the hearing with you and will conduct all advance preparation needed to ensure the hearing goes as smoothly as possible.
- About 10 to 12 weeks after the hearing, the bankruptcy court will issue a discharge of your debts.
